Volunteer Waiver

Thank you for volunteering with us today! Please read this document carefully. It affects your legal rights.
THIS RELEASE AND WAIVER OF LIABILITY (this “Release”) is executed on _________________, 2021, by____________________________ (the “Volunteer”) and _________________________________________ (the “Guardian”) (if the Volunteer is under 18 years old) (collectively, the “Undersigned”) in favor of Cornerstone Corporation, a Missouri nonprofit corporation, its successors and assigns, its directors, its agents, and its employees and staff (collectively, “Cornerstone”).
The Undersigned desire(s) that the Volunteer participate in certain projects and other activities of Cornerstone (the “Project”). The Undersigned understand(s) that the Project may include a variety of activities such as construction, demolition, painting, and landscaping taking place in and around older buildings which may contain lead paint located in the City of St. Louis. The Undersigned recognize(s) that there are inherent risks and dangers in performing the Project. The Undersigned further understand that Cornerstone has the right to refuse to allow any Volunteer to participate in the Project for any reason in the sole discretion of Cornerstone.
The Undersigned freely execute(s) this Release under the following terms:
1. Waiver and Release. By signing this Release, the Undersigned hereby release(s) and hold(s) harmless Cornerstone from any and all liability, claims, or demands of whatever kind or nature which arise as a result of Volunteer’s participation in the Project. The Undersigned understand(s) that this Release Discharges Cornerstone from any and all liability, claims, and demands of whatever kind or nature which arise as a result of Volunteer’s participation in the Project.
2. Medical Treatment. The Undersigned release(s) Cornerstone from any claim whatsoever which arises as a result of any first aid, treatment, or service rendered in connection with the Volunteer’s participation in the Project, or with the decision by any representative of Cornerstone to exercise the power to consent to medical or dental treatment.
3. Assumption of Risk. The Undersigned understand(s) that the Project may include activities which may be hazardous to the Volunteer. Therefore, the Undersigned assume(s) any and all risk of any kind that may arise out of the Volunteer’s participation in the Project.
4. Insurance. Cornerstone expressly disclaims any responsibility for providing any insurance for the Volunteer, including, but not limited to, health, medical, liability, or workmen’s compensation. EACH VOLUNTEER IS EXPECTED AND ENCOURAGED TO ARRIVE WITH MEDICAL OR HEALTH INSURANCE COVERAGE IN EFFECT.
5. Photographic Release. The Undersigned understand(s) that Cornerstone may take photographs or make video or audio recordings in connection with the Project. By signing this Release, the Undersigned transfer(s) to Cornerstone all right, title, and interest in any and all photographic images and video and audio recordings made by Cornerstone in connection with the Project, including, but not limited to, any royalty benefits or other proceeds that could be received from such photographs or recordings.
6. Governing Law; Severability. The Undersigned expressly agree(s) that this Release is permitted and governed by the laws of the State of Missouri. Further, the Undersigned agree(s) that in the event that any clause or provision of this Release is held to be invalid by a court of competent jurisdiction, the invalidity of such clause or provision does not otherwise affect the remaining provisions of this Release which will continue to be enforceable.
7. Parking Disclosure. In the event of an unfortunate occurrence, Cornerstone cannot be responsible for loss, theft, or damage of or to any of the Undersigned’s personal property, including any vehicles. The Undersigned understand(s) that he, she, or they should not leave any valuables of any kind in any vehicles (including under the seat or in the trunk). Cornerstone recommends that volunteers do not bring ANY valuables to the worksite. In addition, Cornerstone cannot be responsible for any parking tickets that may be issued to the Undersigned.
